View Full Version : UPDATE ON MY VIP PROJECT!!! WTFBBQ!!!

So...I get off work early, and drop off my girlfirend at her house. I was all like this :-X and she was all like ??? so then i was like :buck2:. Plus her pops came out and was talking to her, so i couldnt chill for a bit :-[ So then i bounce. and im driving home, about 3 minutes after i leave (literally) i cross this intersection and BAM! :o i dont know WTF happened! i saw some headlights outta the corner of my eye and i was spinning! woo hoo dorifto master right here! i know i spun once, at least twice.
i was in the left lane on a one way street, and ended up spinning across three lanes of traffic, ending up against the curb. by the time i came to my senses (it was pretty crazy i was a little dazed, didnt realize what happened it happened so quick) i checked myself, grabbed my keys outta the ignition and jumped outta the car. I started walking down the street, and I see 3-5 people (dont remember there was a few though) standing around the car. im walking up to them, and im like "you guys alright?" and they were like "No, this isnt our car, you didnt hit us, the people you hit, they ran off that way" ??? "what? Ah FUCKK!!!! :tickedoff:" i looked around, those fools were gone. so then im just kinda looking around, like WTF to do now, call the cops, as well as like 3 other people are doing the same thing. like 5 minutes later, the cops come, and the officer jumps outta the car, and starts asking people what happened. they were all trying to tell the story, and i was like "yO, im the one that got hit!" so then starts talking to me. tell him i dont even know whats going on, as the people who hit me had ran off so quick.
He runs the plates on the car, then looks at me and hes like it's stolen. great. he asks me if my car is driveable, and then was like, no probably not huh?
the other car was mangled. i mean the front was totally crushed in, im surprised these people were able to get outta the car so quickly. it was one helluva impact. they were going so fast, that they plowed into my rear quarterpanel, dead on with the rear door, tire, and rear panel, spun me out, and slid through three lanes of traffic (luckily hitting no one else) and came to a stop on the other side of the street. (see diagram) i dont know how i didnt hit the other cars on the street, as i think i should have spun out and hit the ones on the side of the street in front of me. but i was hit so hard that it threw me to the other side of the street. those guys ended up on the other side of the intersection as well.

after about 45 minutes, car was loaded up onto a tow truck, and i found out then that my gas tank i guess crumpled a little bit and was punctured/leaking gas. lucky no sparks at the time eh!? JDM headlights/HID's are ok, so i will probably sell those, and throw the stock headlights back in. my fusa is ok (haha) and im pretty sore. my neck is killing me and i will be going to the dr tmw or wednesday, as soon as i can get time for an appt. im guessing my car is totalled, i'll take pictures, because the ones on my phone arent gonna do it justice. the rear driver side tire is like \_\. the best thing i can hope for, is that they either find the guy who stole the car ( probably wont be able to do anything) or at least the car was stolen soon enough to getting wrecked that the owners (even though this is a fucked up way of doing things) insurance (if it wasnt already cancelled) will be able to pay my car out/get me a medical settlement. i dont have 2 way, all i have is 1 way, but i do have UMPD and UMPD bodily injury. so if worse comes to worse ( which it will) i will at least be getting 3500 (yeah i know, not much) out of my car, as if the damage is more than the value of the car (6k i KBB'd it) which is probably is, then they will call it a total loss, and i will just get the UMPD coverage which is 3500. settlement? probably wont get this one, unless the owner of the car had insurance.
if they do assess the damage and its cutting it close to the value of the car (a little over) then i will try to haggle with them offer to have them pay up to that point, but not to where they will total out the car, and then i would pay out of pocket to cover the rest. that way i would get more than 3500 out of it, fat chance though. all in all atleast i'm ok.

damn, best thing is that you're safe.
insurance wise:
1. you'll need to go through your own insurance under your uninsured motorist protection/coverage (you described as umpd). your insurance company will be handling it. remember, while dealing with this, you'll be in a rental car. assuming you have typical coverage, your insurance ride will be 80/20 (insurance pays 80%, you pay 20%) of the first $500, and thereafter you pay the full amount. $500 on a rental is about 2 weeks worth.
2. since the car of the other party was stolen, you'll be lucky to get any medical settlement from the other insurance company. the insurance company of the stolen car likely won't pay out any medical settlement, given that their party was not at fault. remember, it's driver's who are insured for the vehicles that they drive. the other vehicle was driven by someone unknown to the owner.
3.if by 1 way you mean liability, and by 2 way you mean collision and comprehensive coverage... then it seems that in a way you may be s.o.l. as i said, the other insurance company isn't under any obligation to you, as their driver was not at fault. if/when found, the other insurance company will fix the car of their loss, your insurance company fixes the car of their loss. unfortunately, neither party is at fault, and neither party owes each other anything.
this leads me to
4. you have a civil case against the party that stole the car. unfortunately, the criminal case comes first, and if the party is out boosting/stealing/jacking cars, they likely don't have many assets to go after. and seeing as how they're looking at a bit of jail/prision time (i suppose it depends on how many "strikes" the party has), they're won't be much income to garnish.
5. don't expect the value of the car to be estimated at 6k. expect it to be less- in the neighborhood of what you were attempting to sell it for is more likely. make sure to have all of your receipts as far as any aftermarket parts. but if, as you stated above, you only have liablity, you may find it a bit more difficult. your own insurance company's responsiblity to you is to restore your car to oem/stock value (unless you have an additional "rider"/coverage- which you likely don't have given only having liability) or you had the aftermarket items at the time of purchasing insurance (which is still questionable generally).
had you been hit by the owner of the vehicle that hit you, the process would be a bit simpler, as they would have to restore the car to "as is/was" quality, rather than oem/stock- i.e. you can find it easier to get compensation for your car and aftermarket items when you're not at fault and the other party is. unfortunately, the driver of the other insurance company is not at fault.
6. if you're lucky, the guy that stole the car has insurance with some company. though i wouldn't hold out for this one.
again, sorry for your loss. honestly, be glad that you're alive and in one piece.

2.if i can get a medical settlement then great, if not i have medical coverage through my own insurance, i dont know how that works, i need to talk to my claims advisor and have her tell me what to do with that.
3. i have liability, uninsured motorist, and uninsured medical. basically no comprehensive, no collision. with the insurance company (as most) you either have UMPD or collision/comp. since it was cheaper with UMPD (they wanted me to pay almost as much as i paid for the car, yeah right!) i opted for UMPD. lucky me! haha.
4. they probably wont catch whoever did it, and im pretty sure that i wont get anything out of it anyways.
5. KBB estimated it at 5800. as i remember from previous accidents, they paid out what the car was worth according to kbb. this was from the at fault party's insurance though, not my own. 3500 is better than nothing though right? also, aftermarket parts, i had nothing that i m worried about. headlights and eveyrthing are all good, i have the stock stereo that i can throw back in, i kept all the old parts and can swap them back real quick. boy i wish i got hit by somebody with insurance right now, i'd feel alot better about not worrying to have to find a 'cheap' car now. work with what you got.

my feeling is that the other party is the person driving the car, not the person who owned the car which was stolen.* it would be different if the car in question was borrowed by a friend, rather than being stolen.* as such it was an unauthorized use.*
this of course doesn't mean that your insurance company won't try to get the other company to pay; but i would doubt it seeing as how their (the other) company would pay when their customer/client wasn't involved.
of course this all changes if of course it turns out the car wasn't stolen.
but assuming the car was stolen, the other party should be the one driving the car... which you stated likely won't be caught. :(

depends what your medical coverage is.* 10k vs. 20k vs. 100k vs. 250k per person per accident... generally it's reimbursed after the fact.* i.e. you don't get paid up front, you get paid on the back end- after you've seen a health care professional and had your workup and treatment.
also, your claims advisor isn't a health professional (like me :D).* if you're truly hurt, get checked out as soon as possible.* if you're not truly hurt right now, you have up to 1 year to see a doctor and for you to file a retroactive claim if need be.

i was just in an accident, not at fault, in january (the reason that i now have an ls400 myself).* i was offerred far less than kbb through the other insurance company (of note, they offerred 3400 for my accord, yet equivalent accords in terms of year and mileage in so cal were going for 5-6k!).* i had to fight, show receipts for every single aftermarket part (not a problem, as i keep records of everything).* after receiving the settlement, buying the car back just to sell the worthwhile aftermarket parts, i got a little less than i feel i should have received in the first place. luckily, the car that hit me stuck around and wasn't stolen.
all in all, again, be glad that your alive. try your damnedest to get what you feel you deserve, but also remember the longer you wait it out, the longer time you're potentially spending money out of your own pocket. start getting your receipts in order, start looking for another vehicle now. get your ducks in a row before the insurance company has their's in a row.

i've found a couple of cars i have in mind. im going on the fact, that the insurance lady guaranteed me 3.5k which is what the umpd covers. my insurance company didnt let me have comp/collision/umpd, it was one or the other. its an out of state company too, and at the time, i needed insurance and they were the cheapest. now i see why haha. they specified that if i didnt get the coverage for aftermarket parts they will not be covered. thats why im not worried about that part. i see the people who hit you's insurance company tried to jack you, just like suspended was getting jacked on an estimate. if they try to say that my car is worth 2000 dollars, im going to fight back, i know for damned sure the car's worth at least 4k, the KBB was at almost 6k. i'll have to fight back with that. i've always had it in very good condition, this is the first wreck it's been in also. (had a carfax, and will get one again if need be). so im betting on only getting the 3.5k and then turning around and selling the jdm headlights, blinkers, HID kit, basically wahtever i can salvage off the vehicle before they come get it. if you need any little parts let me know haha, i'll get back at the insurance company one way or another. and yeah, evne though this isnt a good turnout for the car, it could be worse. they could have been going 5mph faster, or i could have been there half a second sooner, and be in a lot worse condition right now. im glad all i got is a stiff neck for now. im going to make an appt to go to the dr wednesday, since i will be busy all day with school and work. happy bday to me! what a birthday present eh?
